Agreement and eligibility

These Terms of Service (“Terms”) are an agreement between you and the operator of HumanShade (“HumanShade,” “we,” or “us”). They govern your access to humanshade.com and the HumanShade dashboard, playground, HTTP API, MCP server, software, and related services (collectively, the “Service”). By creating an account, buying credit, or using the Service, you agree to these Terms and our Privacy Policy.

You must be at least 18 years old and legally able to enter a binding contract. If you use the Service for an organization, you represent that you can bind it to these Terms, and “you” includes that organization. Do not use the Service if you do not agree.

The Service

HumanShade rewrites text using server-controlled writing modes. The Service is available through the playground, API, and MCP server, subject to account balance, request-size, rate, concurrency, and other operational limits we publish or enforce.

Machine-generated output can be incomplete, inaccurate, unsuitable, or similar to content produced for others. You are responsible for reviewing output before using or publishing it. HumanShade does not guarantee that output will satisfy an AI detector, platform rule, academic policy, legal requirement, or professional standard.

Accounts and API keys

You must provide accurate account information, protect your authentication methods and API keys, and promptly revoke a key or notify us if you suspect compromise. You are responsible for activity performed through your account or keys unless applicable law provides otherwise.

API keys are secret credentials. Do not place them in URLs, public repositories, client-side code, shared logs, or any location accessible to unauthorized people. We may limit, revoke, or rotate credentials when reasonably necessary to protect the Service.

Acceptable use

You may not use the Service to:

  • break the law, infringe rights, or violate a contract or platform policy;
  • deceive, impersonate, defraud, harass, threaten, or facilitate abuse of a person;
  • produce or distribute malware, phishing, spam, or instructions for harmful activity;
  • submit content you do not have the right or lawful basis to process;
  • bypass access controls, rate limits, billing, security testing restrictions, or technical safeguards;
  • probe or disrupt the Service or use automated access outside the documented API;
  • resell, sublicense, or provide shared access to the Service without our permission; or
  • misrepresent generated output as independently verified fact or professional advice.

We may investigate suspected misuse and limit or suspend access when reasonably necessary to protect users, third parties, or the Service. We will provide notice when appropriate and legally permitted.

Your content and output

As between you and HumanShade, you retain your rights in text you submit. You grant us a limited right to process it only as needed to provide, secure, and support the Service and comply with law. Our Privacy Policy explains that customer input and generated output are not stored by default or used for model training.

Subject to applicable law and third-party rights, we assign to you any rights we may have in output generated specifically for you. Because automated systems may produce similar text for different users, output may not be unique or eligible for intellectual-property protection. You are responsible for determining whether your input and use of output are lawful and appropriate.

Subscriptions, word credits, and charges

HumanShade offers monthly subscriptions with word credits shared by the web app, API, and MCP. An active subscription is required to execute requests or purchase additional word credits. The minimum top-up is currently $5.

Each subscription includes the monthly input-word allowance shown at checkout. Monthly credits expire at the end of their billing period; purchased credits do not expire and are used after monthly credits. Current prices, word-counting rules, daily request limits, and top-up rates are published in the Service. Operational request-size, rate, concurrency, and abuse limits still apply.

Polar is the merchant of record for checkout and processes payment, tax, receipts, disputes, and approved refunds under its buyer terms. A redirect does not prove payment; a plan or credit is activated only after HumanShade verifies an authoritative successful payment event. You authorize us and Polar to process your selected subscription, top-ups, and applicable taxes. We may correct billing errors and will not make your available word credit balance negative.

Refunds

Subscription, top-up, and usage charges are non-refundable except where required by law or approved by us or Polar. To request a review, email support@humanshade.com with the account and transaction details, but never include an API key or full payment-card number.

If a top-up is refunded, reversed, or charged back, we may remove the corresponding unused credit. If you have already spent that credit, we may freeze future use while the resulting balance obligation is reviewed and resolved. Nothing in this section limits non-waivable consumer rights.

Our technology

HumanShade and its licensors own the Service, including its software, interfaces, design, trademarks, documentation, prompts, and other technology, excluding your content and output rights described above. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service under these Terms. Feedback you voluntarily provide may be used without restriction or compensation, provided we do not identify you publicly without permission.

Changes and availability

We may improve, modify, limit, or discontinue features and may update models, pricing, and operational limits. We will provide reasonable advance notice of material changes when practicable. Price changes apply prospectively and do not rewrite historical charges.

The Service may be interrupted for maintenance, provider failures, security events, or circumstances beyond our control. We do not promise uninterrupted or error-free operation. We may use reasonable controls to manage capacity and prevent abuse.

Suspension and termination

You may stop using the Service at any time. You may request account closure by contacting support. We may suspend or terminate access if you materially breach these Terms, create a security or legal risk, fail to resolve a payment reversal, or use the Service in a way that could harm HumanShade, users, or third parties.

Where appropriate, we will give notice and an opportunity to cure. After termination, provisions that by their nature should survive will remain effective, including payment, ownership, disclaimers, liability, and dispute provisions. Records may be retained as described in our Privacy Policy.

Disclaimers

To the maximum extent permitted by law, the Service and output are provided “as is” and “as available.” HumanShade disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. HumanShade does not provide legal, medical, financial, academic, or other professional advice, and output is not a substitute for qualified review. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

Limitation of liability

To the maximum extent permitted by law, HumanShade and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from the Service or these Terms, even if advised that such harm is possible.

To the maximum extent permitted by law, the total liability of HumanShade and its suppliers for all claims arising from the Service or these Terms will not exceed the greater of $100 or the amount you paid to HumanShade for Service use during the six months before the event giving rise to the claim. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

General terms

These Terms and the Privacy Policy are the entire agreement about the Service and replace prior discussions on that subject. If a provision is unenforceable, it will be modified only as much as necessary and the rest will remain in effect. A delay in enforcement is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, financing, reorganization, or transfer of the Service.

We may update these Terms by posting a revised version and changing the effective date. We will give additional notice of material changes where required. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
